Your order

With your payment, you submit a binding offer to me.

With the booking of the package on your license, the order is accepted and a contract is concluded.

You hereby expressly agree that the provision of my services and the provision of digital content begins immediately upon receipt of payment.

Subscriptions

The subscription is for one license of a website and is non-transferable.

The duration of the subscription depends on the subscription duration of the selected package.

The subscription is not automatically renewed and is considered terminated upon expiration of the purchased time.

Please note that you will not be refunded any money as you may continue to use the digital content and services until the subscription expires.

Prices and payment

According to Section 19 of the German Turnover Tax Act, I am exempt from levying the turnover tax. Therefore the prices do not include VAT and cannot be shown separately.

My services and digital contents are offered to you on a prepayment basis.

The payment is due immediately with your order.

If you choose the payment methods of other providers such as PayPal, the additional conditions and costs of this provider may apply.

Right of withdrawal

You have the right to revoke this contract within 14 days from the day of the conclusion of the contract without giving reasons.

In order to exercise your right of withdrawal, you must inform me in writing by means of a clear declaration of your decision to withdraw from this contract.

Please include your name, address, username, email address of your account, license key, order number, order date and date of revocation.

To comply with the revocation period, it is sufficient that you send the notice of revocation before the expiration of the revocation period.

You agree that the digital content will be delivered immediately and that you will lose your right of withdrawal when you complete the purchase.

Consequences of the revocation

I will refund the payments I have received from you immediately after I have received notice of your cancellation of this Agreement.

For this refund, unless expressly agreed otherwise, I will use the same means of payment as you used for your original payment.

In no case will you be charged for this refund.

If you have requested that the provision of a service or the provision of digital content begin during the withdrawal period, you will have to pay me a reasonable amount corresponding to the volume of services already provided compared to the total volume of services provided in the contract.

Cooperation obligations

You agree to ensure, prior to using any digital content or services, that such use does not violate any law applicable to you.

You further agree to satisfy yourself as to the suitability of the Digital Content or Services for your particular purpose based on the information provided.

You provide the necessary hardware and software environment for the use of the software.

You undertake to protect yourself against data loss through regular, complete and appropriately frequent data backups.

You verify the compatibility of the digital content or services with your specific system by testing them on a test environment.

Before using my digital content or services, make sure you are aware of any known issues.

If anything is unclear or errors are found, you agree to report them to me within 7 days.

You agree to provide me with all the information I need to reproduce and correct any errors.

Limitation of liability

I am not liable for damages caused by the use of my digital content or services, by simple negligence on my part, as long as I have not violated one of my cardinal obligations or an injury to life, body and health has occurred.

I am not liable for damages caused by improper or negligent use.

I am not liable for damages caused by the use in connection with software or services of third parties.

Liability for defects

Should any of my digital contents or services be defective, these must be reported within 7 days of their occurrence.

Defects will be corrected promptly depending on the severity of the defect, I reserve the right to offer temporary workarounds.

Modification of these conditions

I can update or change these terms and conditions at any time without giving reasons.

The changed terms and conditions apply from the next purchase or confirmation when logging into the customer center. The changed terms and conditions can also be sent by e-mail if necessary and then apply if not objected to in writing within 14 days.

You must register to use my services and digital content.

You must choose a unique username and password for your account. You may not disclose this login information to anyone except as permitted by this Agreement.

You must maintain the confidentiality of your login information and are responsible for any use of your login information and account. Whether the purchases are authorized by you or not.

If you discover a security breach or have a reasonable suspicion of unauthorized use, you are obligated to report this to me. You grant me the right to take all measures to remedy the situation.

In order to use my services and digital content, you must add a license for your website to your account. You can do this in the Customer Center under "Websites".

Licensing

If you agree to this agreement, I grant you the following non-exclusive, non-sublicensable, limited license to use my services and digital content.

Any license associated with your account may only be used for services and digital content on the linked site under your legitimate control.

You may not transfer your rights and obligations arising from the use of my Services and Digital Content.

License restrictions

I reserve the right to suspend or terminate your license to use my digital content or services in whole or in part if they violate or assist others in violating the license restrictions.

No derivative works of my digital content or services may be created. This includes copying, translating, modifying, reverse engineering, decompiling or creating derivative works based on or related to my Services or Digital Content.

You may not use any unauthorized third party tools, links or portals that are designed to circumvent protection or licensing.

You may not sell, rent, grant, transfer or sublicense any copies or backups of my services or digital content, or any portion thereof, to any other party.

My Digital Content and Services may not be used to violate any applicable law or regulation.

Ownership

I am the owner or licensee of my services and digital content and accounts, including user names, documentation, all content on the Website and any data and communications generated by them.

Modification of these agreements

I can update or change these agreements at any time without giving reasons.
